Terms of Service

Bregora is a customer-communication platform: it gathers messages from Facebook Messenger, Instagram, WhatsApp, email and website chat into one inbox so a travel agency's team can answer them in one place. These terms govern the use of that platform. They are written for the staff and the agency using it — if you are a customer who simply messaged the agency, the page that concerns you is the Privacy Policy.
Who may use the platform
Access is granted by Hima Travel to named people. An account belongs to one person and is not to be shared: the platform records who replied to which customer, and a shared login destroys that record just when it matters — a complaint, a dispute, a mistaken price quoted to a client.
Anyone using an account must be an adult acting for the business, and must keep their password to themselves. Tell us immediately if you believe an account has been compromised.
What the platform is, and what it is not
The platform carries messages between the agency and its customers, and keeps a record of them. It does not send messages on its own initiative: everything that leaves it was written, scheduled or configured by a person at the agency, including automated replies and campaigns.
That distinction matters for what follows.
The agency is responsible for what it sends
The agency using the platform — not the platform — is responsible for the lawfulness of every message it sends through it. In practice that means:
- Only messaging people who contacted the business or who agreed to be contacted. The platform does not supply contacts and never will.
- Honouring every opt-out. When someone replies STOP, or asks to be left alone in any wording, that person must not be messaged again with offers. The platform records opt-outs and applies them, but it cannot undo a message already sent.
- Following the rules of each channel it sends on — in particular the WhatsApp Business Messaging Policy and Meta's Platform Terms. A suspension imposed by Meta on the business account is a consequence of how the account was used.
- Being truthful in what is offered: prices, availability and terms quoted to a customer must be ones the agency can honour.
- Handling customer documents responsibly. Passports and similar files sometimes arrive in a conversation; ask for them only when a booking genuinely requires it.
Things you must not do with it
- Send unsolicited bulk marketing, or import a contact list the business has no consent for.
- Use the platform to harass, deceive or defraud anyone.
- Attempt to reach data belonging to another business or another user of the platform.
- Probe, scrape or attack the service, or work around its access controls.
- Resell or expose access to a third party without written agreement.
Any of these can end access immediately, because they put the business's messaging accounts and its customers at risk.
Availability
We aim to keep the platform running continuously, and it is monitored around the clock, but we do not promise uninterrupted service. Maintenance, a provider outage, or an interruption at Meta can all stop message delivery for a period.
When a channel is unavailable, incoming messages are generally re-delivered by the provider once service returns — Meta retries Messenger and Instagram webhooks for about 36 hours, and WhatsApp for about 7 days. Nothing is guaranteed by us beyond that, and a message is not considered received by the agency until it appears in the inbox.
The data in the platform
Customer conversations and records belong to the agency. We hold and process them on its behalf, as described in the Privacy Policy, and we do not sell them or use them to build advertising profiles.
Backups are taken daily. On request we return the agency's data in a portable form; on termination it is deleted after a reasonable handover period.
Limits of our liability
The platform is provided as it is. To the extent the law allows, we are not liable for lost profit, lost bookings, lost data, or for damage arising from how the agency used the platform — including messages sent to the wrong person, offers quoted in error, or an account suspended by a messaging provider.
Nothing here limits liability that cannot lawfully be limited, including for death, personal injury, or fraud.
Ending access
The agency can stop using the platform at any time. We can suspend or end access where these terms are breached, where a messaging provider requires it, or where continued use would put customer data at risk. Where circumstances allow, we give notice first and time to export the data.
Changes to these terms
If these terms change materially, we update this page and its date, and tell the agency. Continued use after that means the new terms apply.
